If you have a criminal conviction, including a DUI/DWI, you are likely considered criminally inadmissible to Canada. This means you risk being denied entry at the border. However, Canada offers two distinct legal pathways to overcome criminal inadmissibility: the Temporary Resident Permit (TRP) and Criminal Rehabilitation.  

Understanding the difference between these two is critical, as one is a short-term fix while the other is a permanent solution.  


🚦 Inadmissibility and Legal Mitigation Pathways

The primary policy driving these pathways is the need to maintain border security while providing legal mechanisms for individuals who pose a low risk to Canadian society to enter. Your conviction’s severity under Canadian law determines your eligibility and the best path forward.  

For a DUI/DWI conviction occurring after December 18, 2018, the offense is classified as serious criminality in Canada, as the maximum penalty is ten years or more imprisonment. This significantly impacts your options.

🩹 Temporary Resident Permit (TRP): The Short-Term Fix

The TRP is an emergency measure for individuals who have a compelling reason to enter Canada and whose need for entry outweighs the risk they pose.  

Key Criteria for an Overcome Criminal Inadmissibility TRP:

  1. Justification: You must demonstrate a strong, compelling reason for your visit. Tourism or casual travel is rarely accepted unless you are not yet eligible for Criminal Rehabilitation.
  2. Risk vs. Reward: An immigration officer must determine that your need to be in Canada (e.g., attending a critical business meeting, family emergency) is greater than the risk to Canadian society.
  3. Application Process: You can apply at a Canadian consulate/visa office in advance or, in urgent, justified cases, at a Port of Entry (POE). The TRP processing fee is typically CAD $239.75.  
  4. Duration: TRPs are granted for a specific duration, often matching the length of your trip, but can be up to three years for recurrent business travelers.  

Tip: The TRP is the only option if it has been less than five years since you completed your DUI/DWI sentence.  


✅ Criminal Rehabilitation: The Permanent Solution

Criminal Rehabilitation is the gold standard for permanently resolving criminal inadmissibility. Once approved, you are no longer inadmissible to Canada for the offense and can travel freely without seeking special permission.  

DUI/DWI and Criminal Rehabilitation Timeline

To be eligible to apply for Criminal Rehabilitation, you must wait five years after you have fully completed your sentence. This includes all:  

  • Jail time or house arrest.
  • Parole or probation.
  • Payment of all fines and restitution.  
  • Completion of any court-ordered driving prohibitions.  

Processing Fee Note: Since DUI/DWI is now considered “serious criminality,” the application fee is generally CAD $1,199.75. If your offense is deemed non-serious, the fee is CAD $239.75.  

Application Strength: The application is intensive, requiring police certificates, court documents, and a Personal Statement of Rehabilitation demonstrating that you are unlikely to re-offend and have established a stable, law-abiding life.  


⏳ Deemed Rehabilitation Timeline: The 10-Year Test

Deemed Rehabilitation is an automatic process where an immigration officer can consider you rehabilitated by the passage of time. Crucially, you do not apply for it you must simply meet the criteria and prove it to the officer.  

The DUI Exemption (The Crucial Caveat)

As a result of Bill C-46 (enacted on December 18, 2018), the rules for impaired driving changed drastically:

  • DUI/DWI committed ON or AFTER December 18, 2018: These offenses are considered Serious Criminality and are NEVER eligible for Deemed Rehabilitation. You MUST apply for Criminal Rehabilitation.  
  • DUI/DWI committed BEFORE December 18, 2018: You may still be eligible for deemed rehabilitation timeline if:
    • It was your only offense.
    • The crime is equivalent to a non-serious indictable offense in Canada (which it was before 2018).  
    • 10 years have passed since you completed your entire sentence.  

If you fall into the pre-2018 group, you must carry all court and completion documents to the border to prove your eligibility to the CBSA officer.
