How long will I be able to work on an LMIA-based work permit through the TFWP?

The validity period of your employer’s Labour Market Impact Assessment (LMIA) does not determine the length of your employment in Canada. Instead, the duration you can work is governed by the validity period of your LMIA-based work permit under the Temporary Foreign Worker Program (TFWP), which is influenced by a “work duration” recommended by Employment and Social Development Canada (ESDC) based on the employer’s LMIA application. Immigration, Refugees and Citizenship Canada (IRCC) uses this recommendation to establish your work permit’s validity.

Example: Applying for a TFWP Work Permit
Consider a scenario where a Canadian automobile manufacturer hires a foreign mechanical engineer through the TFWP:
- The employer applies for an LMIA by July 30, 2025, targeting a start date of December 1, 2025.
- A positive LMIA is issued on September 19, 2025, with a 6-month validity (until March 19, 2026) and a one-year work duration.
- The foreign worker applies to IRCC on September 30, 2025, and receives a work permit valid from December 18, 2025, to January 30, 2027 (slightly over one year), accounting for travel and processing time.
- To extend employment beyond this period, the employer must obtain a new LMIA, and the worker must apply for a work permit extension before the current permit expires (recommended at least 30 days prior, e.g., by December 31, 2026). Maintained status allows continued work under the same conditions while the extension is pending, provided the worker remains in Canada with the same employer and role.
How to Obtain an LMIA
An LMIA is a mandatory document from ESDC that assesses the impact of hiring a foreign worker on the Canadian labor market, ensuring no Canadian citizen or permanent resident is available for the role.
LMIA Application Process
- Employer Applies for an LMIA:
- The employer submits an application to ESDC, typically after advertising the job in Canada for at least four weeks to demonstrate local recruitment efforts (with exceptions for certain positions).
- The application includes details on wages, working conditions, and recruitment efforts, along with a processing fee.
- Upon approval, ESDC issues a positive LMIA, valid for 6 months from May 1, 2024, onward.
- Foreign Worker Applies for a Work Permit:
- The employer provides the positive LMIA to the selected worker, who then applies to IRCC.
- Required documents include the LMIA, a job offer letter, employment contract, proof of qualifications (e.g., education, certifications), and applicable fees/biometrics.
- An approved application results in a closed work permit, restricting the worker to the specified employer and role.

Factors Influencing Work Permit Duration
- LMIA Validity Period: The 6-month window during which the worker must apply for a work permit. A new LMIA is needed if this expires before application.
- Work Duration: ESDC’s recommended period (e.g., one year) based on labor market impact, guiding IRCC’s work permit expiry date.
- Work Permit Expiry Date: Set by IRCC, reflecting the work duration plus potential adjustments for travel, determined case-by-case.
Handling Jobs Starting After LMIA Expiry
A job can begin after the LMIA expiry date if the work permit application is submitted before that date. The employer should specify the anticipated start date in the LMIA application to inform ESDC and IRCC’s duration assessments.
LMIA Processing Times (as of June 2025)
Processing times vary by stream, influenced by application volumes:
| Stream | Time in Business Days |
|---|---|
| Global Talent Stream | 9 |
| Agricultural Stream | 14 |
| Seasonal Agricultural Worker Program | 8 |
| High-Wage Stream | 41 |
| Low-Wage Stream | 45 |
| Permanent Resident Stream | 240 |
